Participant Assumption of Risk, Waiver, Release of Liability, Refund Policy and Indemnity Agreement
Assumption of Risk
You agree that participation in XCELERATED LLC programs, including speed performance and agility training, strength and conditioning, group training, testing, and recovery services, involves inherent risks, including injury, illness, disability, or death. Participants voluntarily assume all risks associated with participation, including use of facilities, equipment, and premises.
Release of Liability
Participants release and discharge XCELERATED LLC, its owners, members, employees, contractors, volunteers, agents, and facility partners from any and all claims for injuries, losses, or damages arising from participation, including claims of negligence, to the fullest extent permitted by California law.
Medical Clearance
Participants certify they are physically fit and cleared by a medical professional to engage in strenuous exercise. Participants agree to notify XCELERATED LLC of any pre-existing conditions or limitations.
Emergency Authorization
Participants authorize XCELERATED LLC to obtain emergency medical treatment if necessary and accept full financial responsibility for such care.
Refund Policy / No Refund Policy
All sales are final. No refunds will be issued for camps, training sessions, programs, merchandise, or services. If XCELERATED LLC cancels or reschedules an event, a credit may be issued toward a future program at the discretion of XCELERATED LLC. A refund may be considered only with written documentation from a licensed physician stating the participant is medically unable to participate due to injury or illness. No refunds or credits will be issued for missed sessions, scheduling conflicts, personal reasons, or failure to attend. XCELERATED LLC reserves the right to determine eligibility for any exception on a case-by-case basis.
Media Release
Participants and/or parents/guardians grant permission for XCELERATED LLC to use photographs or video footage for promotional purposes unless declined in writing prior to participation.
